Which Chapter? 7 or 13?
The decision as to which type of bankruptcy to file should only be made after speaking with a bankruptcy attorney.
The most commonly filed bankruptcy both in my office and across the United States is a Chapter 7 in which you are basically stating that you cannot afford to pay your creditors anything and you wish to have the debt wiped out by order of the court via a bankruptcy discharge. The other kind of bankruptcy, Chapter 13 which represents about 30% of my cases involves a court supervised repayment plan in which you repay your creditors over a three to five year time period based on whatever you have left over after paying your reasonably monthly living expenes.
